Under NC Statute § 14-33, assault and battery is usually classified as a Class 2 misdemeanor.  The charges can escalate to a more serious charge when the circumstances allege the occurrence of serious injury, the presence of a deadly weapon, or certain protected victims.

Simple Assault and Battery

A simple assault and battery charge involves an allegation of unwanted physical contact or an attempted strike without the more serious aggravating factors that can elevate the offense. A conviction may result in probation, fines, court costs, or up to 60 days of jail exposure, depending on the facts of the case as well as the defendant’s prior criminal record.

Assault and Battery Charged as a More Serious Misdemeanor

NC Statute § 14-33(c) outlines when assault, assault and battery, or affray may be charged as a Class A1 misdemeanor. The State may treat the case more seriously depending on who was involved and the circumstances of the incident. A conviction at this level can carry more than just a criminal record. Depending on the person’s prior conviction level, the sentencing range may reach up to 150 days in jail, along with probationary terms and a court-imposed fine. One major issue with A1 misdemeanor convictions is that they are not ever eligible for expunction under current North Carolina Law.

  • Use of a deadly weapon
  • Assault on a female by a male at least 18 years old
  • Assault on a pregnant woman
  • Assault on a child under 12
